Section 19 of the Act respecting the legal publicity of enterprises states clearly that registration of a name in the Quebec Enterprise Register confers no guarantee of ownership of the name which appears in the register. However, the registration of a trade-mark in the trade-mark register is prima facie evidence of ownership. And, even if the mark is only used in certain provinces, one benefit of registering your trade-mark is that it’ll be protected across the country.
